Terms of Service

These Terms of Service ("Terms") govern your use of the SousMarketer platform operated by SousMarketer ("SousMarketer", "we", "us"), a company registered in the Netherlands. By creating an account or using our services, you agree to these Terms.
1. The service
SousMarketer is a marketing platform for restaurants. The platform provides tools for photo generation, content creation, review response management, and social media scheduling, powered by artificial intelligence and personalized through a Brand Voice system.
The platform is available at app.sousmarketer.com. These Terms apply to all users of the platform, including free trial users and paid subscribers.
2. Account registration
To use SousMarketer, you must create an account with a valid email address. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
You must be at least 18 years old to create an account. By registering, you represent that you have the authority to agree to these Terms on behalf of yourself or the restaurant you represent.
3. Free trial
New accounts receive a free trial that includes a limited number of credits for each feature: 3 photo generation credits, 5 content creation credits, and 10 review response credits. The free trial does not require a credit card.
Brand Voice setup is unlimited and not counted against trial credits. If your credits are exhausted, you may upgrade to a paid plan to continue using the platform.
4. Paid subscriptions
Paid plans are billed monthly or annually through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel.
Pricing is displayed on our website and within the platform. We reserve the right to change pricing with 30 days' written notice. Price changes do not apply to the current billing period.
5. Cancellation and refunds
You may cancel your subscription at any time through the platform's settings page. Cancellation takes effect at the end of your current billing period. You retain access to all features until the end of the paid period.
We do not offer prorated refunds for partial billing periods. If you believe you were charged in error, contact us at hello@sousmarketer.com within 14 days of the charge.
6. Your content and data
You retain full ownership of all content you create or upload through SousMarketer, including restaurant information, Brand Voice data, generated photos, written content, and review responses.
By using the platform, you grant SousMarketer a limited, non-exclusive license to process your data as necessary to provide the service, including transmitting it to third-party AI providers (Anthropic, Google) for content generation, and to third-party platforms (Meta, Google Business Profile) for publishing when you explicitly choose to publish.
You are responsible for the accuracy of information you provide and for ensuring that content you publish through SousMarketer complies with applicable laws, including consumer protection and advertising regulations.
7. Generated content
Content generated by SousMarketer (photos, captions, review responses) is created using artificial intelligence. While we strive for high quality, we do not guarantee that generated content is free from errors, factually accurate, or suitable for any specific purpose without your review.
You are responsible for reviewing all generated content before publishing. SousMarketer is not liable for any consequences arising from publishing AI-generated content without review.
Generated photos are created using Google's Gemini image generation technology. You receive a non-exclusive, royalty-free, perpetual license to use generated photos for your restaurant's marketing purposes.
8. Acceptable use
You agree not to use SousMarketer to:
- Generate content that is unlawful, defamatory, or fraudulent
- Impersonate another restaurant or business
- Upload content that infringes third-party intellectual property rights
- Attempt to access other users' data or accounts
- Reverse-engineer, decompile, or disassemble the platform
- Use automated scripts or bots to access the platform (except through our official API, if offered)
- Resell or redistribute access to the platform without our written consent
We reserve the right to suspend or terminate accounts that violate these terms, with or without notice.
9. Third-party integrations
SousMarketer integrates with third-party services including Google Business Profile, Facebook, Instagram, and payment processors. Your use of these integrations is subject to those platforms' own terms of service.
We are not responsible for changes to third-party APIs, service disruptions on third-party platforms, or actions taken by third-party platforms regarding your accounts or content.
When you connect a third-party account, you authorize SousMarketer to access and interact with that account on your behalf within the scope of the permissions you grant. You may disconnect integrations at any time through the Integrations page.
10. Availability and support
We aim to maintain high availability of the platform but do not guarantee uninterrupted service. Planned maintenance will be communicated in advance when possible.
Support is available via email at hello@sousmarketer.com. We aim to respond to inquiries within 2 business days.
11. Limitation of liability
To the maximum extent permitted by Dutch law:
- SousMarketer is provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
- SousMarketer's total aggregate liability to you for any claims arising from your use of the platform is limited to the amounts you have paid to SousMarketer in the 12 months preceding the claim.
- SousMarketer is not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or business opportunities.
- SousMarketer is not liable for the accuracy, quality, or appropriateness of AI-generated content. You acknowledge that AI-generated content requires human review before use.
- Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under Dutch law.
12. Indemnification
You agree to indemnify and hold SousMarketer harmless from any claims, damages, or expenses arising from: your use of the platform, content you publish through the platform, your violation of these Terms, or your violation of any applicable law or third-party rights.
13. Intellectual property
The SousMarketer platform, including its design, code, documentation, and brand, is the intellectual property of SousMarketer These Terms do not grant you any rights to our intellectual property except the limited right to use the platform as a subscriber.
14. Governing law and disputes
These Terms are governed by the laws of the Netherlands. Any disputes arising from these Terms or your use of the platform will be submitted to the competent courts in Amsterdam, the Netherlands.
If you are a consumer within the EU, you also have the right to submit disputes to the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
15. Changes to these Terms
We may update these Terms from time to time. We will notify you of material changes by email or through a notice on the platform at least 30 days before the changes take effect.
Continued use of the platform after changes take effect constitutes acceptance of the updated Terms. If you do not agree with the changes, you may cancel your subscription before the new terms take effect.
16. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
